By downloading, installing, or using Fennington Livestock Tracker ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Fennington Apps reserves the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.
You must be at least 13 years old to use this App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to agree to these Terms. If you are under 18, you may only use the App with the consent of a parent or legal guardian.
Subject to your compliance with these Terms, Fennington Apps grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

If you create an account to use optional features, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Fennington Apps is not liable for any loss or damage arising from your failure to protect your account information.
The App is free to download and use with core features. Premium features may be available through optional subscriptions or one-time purchases. All purchases are processed through the Apple App Store or Google Play Store, and their respective terms and refund policies apply. Subscription fees are non-refundable except as required by law or as specified in the applicable store's policy.
You retain ownership of any data, records, or information you enter into the App ("User Content"). By using the App, you grant Fennington Apps a limited, non-exclusive license to store, process, and use your User Content solely to provide the App's services. You represent that you have the right to provide your User Content and that it does not violate any third-party rights.
The App, including all content, features, and functionality, is owned by Fennington Apps and is protected by copyright, trademark, and other intellectual property laws. You may not use any trademarks, logos, or service marks of Fennington Apps without prior written consent. All rights not expressly granted in these Terms are reserved by Fennington Apps.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FENNINGTON APPS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
Any material downloaded or accessed through the App is at your own risk, and you will be solely responsible for any damage to your device or loss of data.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FENNINGTON APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OR INABILITY TO USE THE APP, EVEN IF FENNINGTON APPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL FENNINGTON APPS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID, IF ANY, FOR ACCESSING THE APP.
You agree to indemnify, defend, and hold harmless Fennington Apps, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any third-party rights.
Fennington Apps may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, disclaimers, and limitations of liability.
Fennington Apps reserves the right to modify, suspend, or discontinue the App at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
The App may integrate with third-party services (such as Firebase, Apple, or Google). Your use of these services is subject to their respective terms and privacy policies. Fennington Apps is not responsible for the practices or content of any third-party services.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the arbitrator's award shall be final and binding.
EXCEPT FOR DISPUTES THAT MAY BE BROUGHT IN SMALL CLAIMS COURT, YOU AND FENNINGTON APPS AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND TO BRING OR PARTICIPATE IN ANY CLASS ACTION, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE ACTION.
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations and the International Traffic in Arms Regulations. You represent and warrant that you are not located in a country that is subject to U.S. government sanctions or designated by the U.S. government as a "terrorist supporting" country.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fennington Apps regarding the App and supersede all prior agreements, communications, and understandings, whether oral or written.
